Acceptance of Terms
By accessing and using the Polygon Digital website and services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
Services
Polygon Digital provides web design, search engine optimization (SEO), and digital marketing services. The specific services, deliverables, timelines, and fees will be outlined in individual service agreements or proposals.
Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information necessary for project completion
- Respond to requests for feedback, approvals, or content in a timely manner
- Ensure you have the rights to any materials you provide for use in projects
- Pay invoices according to agreed-upon terms
Payment Terms
Payment terms will be specified in individual project proposals or service agreements. Unless otherwise agreed:
- Project deposits are required before work begins and are non-refundable
- Invoices are due within 30 days of receipt
- Late payments may be subject to interest charges and/or work stoppage
Intellectual Property
Upon full payment, clients receive ownership of custom work created specifically for their project. We retain ownership of:
- Our pre-existing tools, frameworks, and methodologies
- Generic code or components that may be reused across projects
- Portfolio rights to showcase completed work (unless otherwise agreed)
Limitation of Liability
Polygon Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.
No Guarantees
While we strive to deliver excellent results, we cannot guarantee specific outcomes such as search engine rankings, traffic numbers, or conversion rates. Results depend on many factors outside our control.
Termination
Either party may terminate ongoing services with 30 days written notice. Upon termination, the client is responsible for payment for all work completed up to the termination date.
Governing Law
These Terms of Service shall be governed by the laws of the State of Texas, without regard to conflict of law principles.
Changes to Terms
We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.
